Overview

Auvessa is a trading name of Golden Oak SEO Ltd, a company registered in England and Wales under company number 15740887, with its registered office at 128 City Road, London EC1V 2NX, United Kingdom. "We", "us" and "our" mean Golden Oak SEO Ltd trading as Auvessa. We operate this store and website and everything offered through it (the "Services"). The store is powered by Shopify.

These Terms, together with our Privacy Policy, Delivery page and Returns page, set out the basis on which we sell to you. By placing an order you agree to them. Nothing in these Terms affects your rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other law that protects you as a consumer. If anything here conflicts with those rights, your rights win.

1. Who can order

You must be 18 or over to place an order. You confirm that the details you give us are correct and complete, and that you are buying for personal or household use, not for resale.

2. Our products

Product images on the site are for illustration. The product you receive may differ slightly in colour, packaging and finish, and colours also vary between screens. Product descriptions may be updated over time; the description on the site when you order is the one that applies to your order. We may withdraw a product or limit quantities per customer.

3. Orders and when the contract is made

Placing an order is an offer to buy. We send an order confirmation email straight away, but the contract between us is made only when we send the dispatch email. Until then you can cancel by emailing support@auvessa.co.uk with your order number, and the full amount is refunded. We may decline an order before dispatch, for example if payment fails, if the product is unavailable, if the delivery address is outside the UK, or if there is an obvious pricing error; if we do, we tell you by email and any payment is refunded in full.

4. Prices and payment

The price shown on the product page is the total you pay. Delivery to UK addresses is free and nothing further is due on delivery. Golden Oak SEO Ltd is not VAT registered, so no VAT is charged or shown. Prices and promotions may change, but the price shown when you order is the price for that order.

You can pay by the methods shown at checkout, including debit and credit card, Shop Pay and, where offered, Klarna. If you choose Klarna, your agreement to pay in instalments or later is with Klarna and Klarna's own terms apply to it; your purchase contract remains with us. Payment is taken when you order. You confirm that you are entitled to use the payment method you choose.

5. Delivery

We deliver to UK addresses only. Delivery timings, tracking and what to do if a parcel is late, lost or damaged are on the Delivery page, which forms part of these Terms. We aim to deliver within the window stated there and in any event within 30 days of the order, unless we agree a later date with you. The parcel is our responsibility until it is delivered to you or to someone you nominate, such as a neighbour or a safe place you have chosen. Risk in the goods passes to you on delivery and ownership passes once we have received payment in full.

6. Your right to cancel and the 60-day guarantee

Under the Consumer Contracts Regulations 2013 you can cancel for any reason within 14 days of delivery, by emailing support@auvessa.co.uk or by any other clear statement. Sealed cosmetic products that have been unsealed after delivery can fall outside that right for health and hygiene reasons.

On top of that right, every order comes with our 60-day money-back guarantee, whether the product has been opened or not, with nothing to send back. The full terms, including how and when the refund is issued, are on the Returns page, which forms part of these Terms.

7. Faulty goods

We must supply goods that are of satisfactory quality, fit for purpose and as described. If a product is faulty, damaged or leaking on arrival, or not what you ordered, you can reject it for a full refund within 30 days of delivery, and after that you have the right to a repair or replacement and, if that fails, a refund, in line with the Consumer Rights Act 2015. Our guarantee is in addition to your legal rights and does not reduce them.

8. Using the product safely

Sculpt & Smooth is a cosmetic product for external use on the neck, jawline and décolleté. It is not a medical treatment and it is not a substitute for advice from a doctor, dermatologist or pharmacist. Nothing on this site is medical advice. Follow the instructions supplied with the product. Patch test before first use: apply a little to the inside of your arm and wait 24 hours. Do not use it on broken, sunburnt or irritated skin, and avoid contact with your eyes. If irritation, redness or swelling occurs, stop using it and rinse with cool water; if it does not settle, see a pharmacist or your GP. If you are pregnant, breastfeeding or being treated for a skin condition, check with a healthcare professional before use. Store it in a cool, dry place and keep it out of reach of children.

Results vary from person to person. Images and descriptions of results on the site illustrate typical outcomes and are not a promise of a particular result.

9. Intellectual property

The site and everything on it, including the Auvessa name and logo, text, images, graphics, video and design, belong to us or our licensors and are protected by UK and international intellectual property law. You may use the site for your own personal shopping only. You may not copy, reproduce, distribute, modify or republish any part of it without our written permission. Shopify's name and logo are Shopify's trademarks.

10. Optional tools

We may give you access to tools provided by third parties, such as delivery tracking. We do not control those tools and provide access to them as they are, without any promise about them. Your use of them is subject to the third party's own terms.

11. Third-party links

The site may link to other websites. We are not responsible for their content, accuracy or policies, and you use them at your own risk.

12. Relationship with Shopify

Auvessa is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Auvessa. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Auvessa, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Auvessa.

13. Privacy

Personal information you give us is handled as described in our Privacy Policy. Because the site is hosted by Shopify, Shopify also collects and processes information about your use of the site, as described in the Shopify Consumer Privacy Policy at https://www.shopify.com/legal/privacy/customers.

14. Feedback and reviews

If you send us feedback, a review, a photo or a video, you give us a worldwide, royalty-free licence to use it, including for marketing, in any medium. You confirm that it is your own, that it is honest, and that you have told us about any incentive you received in connection with it. We may edit or remove content that is unlawful, offensive, misleading or breaches these Terms. We are not obliged to publish, respond to or pay for feedback.

15. Errors

Occasionally the site may contain a typing error or an inaccuracy in a description, price, promotion or delivery time. We may correct it at any time. If there is an obvious pricing error on an order we have not yet dispatched, we may cancel that order under clause 3 and refund you in full.

16. Prohibited uses

You may use the site only for lawful purposes. You must not use it to break any law, infringe anyone's rights, harass or threaten anyone, send spam, impersonate anyone, upload malicious code, scrape or copy the site, collect other people's personal information, or interfere with its security. We may suspend or block access if these Terms are breached.

17. Automated agents

If you use or deploy software that acts on your behalf without direct supervision (an "Agent") to access the site, the Agent must identify itself in its user-agent string as "Agent/[agent name]", must not conceal that it is an Agent, must not mimic human behaviour or circumvent CAPTCHAs or other measures that distinguish humans from software, must answer truthfully if asked whether it is human, and must not circumvent any measure we use to control Agent access. We may limit or block Agent access by technical means.

18. Ending access to the site

We may suspend or end your access to the site if you breach these Terms. Doing so does not affect any order already accepted, your rights in relation to it, or the clauses of these Terms that by their nature continue to apply.

19. Information on the site

Information on the site is provided for general purposes and we try to keep it accurate, but we do not promise that it is complete or suitable for your particular circumstances, and it is not medical advice (see clause 8). We do not promise that the site will always be available or error-free.

20. Our liability to you

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for breach of your rights under the Consumer Rights Act 2015, or for anything else that cannot be limited or excluded by law.

Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for loss caused by an event outside our reasonable control provided we have taken reasonable steps to limit its effect. We supply the product for domestic and private use only; if you use it for any business purpose we have no liability to you for loss of profit, loss of business or business interruption.

21. Severability

If any part of these Terms is found to be unenforceable, the rest continues to apply.

22. Waiver and entire agreement

If we do not enforce a right under these Terms straight away, we can still enforce it later. These Terms, together with the Delivery page, Returns page and Privacy Policy, are the whole agreement between us for your order. This does not exclude or limit our liability for misrepresentation.

23. Transfer of the contract

We may transfer our rights and obligations under these Terms to another organisation, for example if the business is sold; we will tell you if that happens and it will not affect your rights. You may not transfer your rights or obligations to anyone else without our written agreement.

24. Governing law

These Terms are governed by the law of England and Wales and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland you can also bring proceedings in Scotland, and if you live in Northern Ireland you can also bring proceedings in Northern Ireland.

25. Complaints

If something has gone wrong, email support@auvessa.co.uk with your order number and we will try to put it right. We are not obliged to use an alternative dispute resolution scheme and we do not currently agree to use one. That does not affect your right to take a complaint to the courts.

26. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order is the one that applies to that order; changes apply only to orders placed after they are posted.
